1. Introduction and Acceptance of Terms

Welcome to Annie ("Annie," "AnnieMusic," "we," "us," or "our"). Annie is a music aggregation platform operated by LogicalLey that unifies Spotify, Apple Music, and Deezer, allowing users to discover and share music across streaming platforms. Annie also offers Looops, a daily music guessing game.

By accessing or using the Annie website (anniemusic.app), mobile applications, APIs, or any related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not access or use the Service.

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website with a revised "Last Updated" date. Your continued use of the Service after such changes constitutes your acceptance of the revised Terms.

2. Definitions

• "Service" refers to the Annie platform, including the website at anniemusic.app, all APIs, the Looops game, and any associated features, tools, or applications.
• "User," "you," or "your" refers to any individual who accesses or uses the Service, whether as a registered (authenticated) user or an anonymous visitor.
• "Account" refers to the registered user profile created when you sign up for Annie.
• "Content" refers to all data, text, images, audio, and other materials made available through the Service, including music metadata, album artwork, and audio previews.
• "Looops" refers to the daily music guessing game feature within the Service.
• "Third-Party Services" refers to Spotify, Apple Music, Deezer, and any other external platforms integrated with or linked from the Service.

3. Eligibility

To use the Service, you must:

• Be at least 13 years of age (or the minimum age required in your jurisdiction).
• If you are between 13 and 18 years of age (or the age of majority in your jurisdiction), have the consent of a parent or legal guardian to use the Service.
• Have the legal capacity to enter into a binding agreement.
• Not be prohibited from using the Service under applicable law.

By using the Service, you represent and warrant that you meet the above requirements.

4. User Accounts

4.1 Account Creation

You may use certain features of the Service without an account (as an anonymous user). To access the full range of features, including game statistics tracking, streaks, and personalized preferences, you must create an account.

When creating an account, you agree to:

• Provide accurate, current, and complete information.
• Maintain and update your information to keep it accurate.
• Maintain the security of your account credentials.
• Notify us immediately of any unauthorized use of your account.

4.2 Account Security

You are responsible for safeguarding your authentication credentials and for all activities that occur under your account. Annie is not liable for any loss or damage arising from your failure to protect your account credentials.

4.3 Account Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, for conduct that we determine, in our sole discretion, violates these Terms, is harmful to other users, or is otherwise inappropriate. You may also delete your account at any time by contacting us.

5. Description of the Service

5.1 Music Aggregation

Annie provides a music aggregation service that:

• Unifies track and playlist data from Spotify, Apple Music, and Deezer.
• Resolves music URLs from any supported platform to provide cross-platform links.
• Allows users to search for and discover music across multiple streaming services.
• Provides track metadata, including titles, artists, album artwork, and preview URLs.

Annie does not host or store full music tracks. Audio previews (typically up to 30 seconds) are sourced from and served through Third-Party Services.

5.2 Looops Game

Looops is a daily music guessing game where:

• Users hear progressively longer audio clips (3, 6, 9, and 12 seconds) and attempt to identify the correct song from multiple-choice options.
• Each user receives one attempt per day. For authenticated users, the daily reset occurs at midnight in their configured timezone. For anonymous users, the reset occurs at midnight UTC.
• Authenticated users receive personalized daily songs based on their stored genre and artist preferences. Anonymous users provide preferences at the start of each session.
• Game statistics (games played, win rate, streaks, round distribution) are tracked for authenticated users only.
• Wrong guesses are eliminated from visible options in subsequent rounds, creating a progressively narrower set of choices.

5.3 Anonymous Usage

Certain features of the Service are available to anonymous (unauthenticated) users, including music URL resolution and playing Looops. Anonymous Looops sessions are subject to daily limits enforced by hashed IP address. Anonymous users do not have access to persistent statistics, streaks, or saved preferences.

6. Acceptable Use

You agree not to use the Service to:

1. Violate any law or regulation, including intellectual property, privacy, or data protection laws.
2. Circumvent usage restrictions, including but not limited to attempting to play Looops more than once per day, using automated tools, bots, scrapers, or scripts, or reverse-engineering audio proxy endpoints.
3. Abuse the Service infrastructure, including overloading, flooding, or attempting to gain unauthorized access to any part of the Service.
4. Harm other users, including by impersonating another person, harassing or threatening other users, or collecting personal information about other users.
5. Interfere with the Service, including by introducing malware, reverse-engineering any portion of the Service, or removing proprietary notices.

We reserve the right to investigate and take appropriate action against anyone who violates this section, including removing content, suspending or terminating accounts, and reporting to law enforcement authorities.

7. Intellectual Property

7.1 Annie's Intellectual Property

The Service, including its design, features, functionality, code, trademarks, logos, and documentation, is owned by LogicalLey and is protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to use the Service for its intended purpose in accordance with these Terms.

7.2 Third-Party Content

Music metadata, album artwork, audio previews, and other content sourced from Spotify, Apple Music, Deezer, and other Third-Party Services remain the property of their respective owners. Annie does not claim ownership of any third-party content displayed through the Service.

7.3 User Content

By sharing Looops game results (e.g., via the share feature), you grant Annie a non-exclusive, royalty-free, worldwide license to use, display, and distribute such shared content for promotional purposes.

8. Privacy and Data Collection

8.1 General

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using the Service, you consent to the practices described in the Privacy Policy.

8.2 Data We Collect

In connection with the Service, we may collect:

• Account information: Email address, phone number, and authentication credentials.
• Preferences: Preferred music genres, preferred artists, and timezone settings.
• Usage data: Game sessions, scores, streaks, round performance, and interaction patterns.
• Technical data: IP addresses (hashed for anonymous users), device information, browser type, and access timestamps.
• Music interaction data: Track searches, URL resolutions, and listening history.

8.3 IP Address Handling

For anonymous Looops sessions, we use a one-way HMAC-SHA256 hash of your IP address to enforce daily play limits. We do not store your raw IP address in connection with game sessions. The hash cannot be reversed to determine your original IP address.

8.4 Third-Party Data Sharing

We integrate with Third-Party Services (Spotify, Apple Music, Deezer) to provide the Service. Your interactions with these services through Annie may be subject to their respective privacy policies and terms. We do not sell your personal data to third parties.

9. Looops Game-Specific Terms

9.1 Fair Play

The Looops game is designed as a fair, skill-based daily challenge. You agree to:

• Play the game personally and not use automated tools or assistance to identify songs.
• Not share answers or spoilers for the current day's game in a manner that ruins the experience for other players.
• Accept the daily limit of one game per day as part of the game design.
• Not attempt to manipulate game outcomes by exploiting technical mechanisms.

9.2 Game Integrity

We reserve the right to:

• Invalidate game sessions obtained through unfair means.
• Reset statistics for accounts found to be in violation of fair play rules.
• Modify game mechanics, scoring, difficulty, or daily limits at any time without notice.

9.3 Audio Content

Audio previews used in Looops are short clips (up to 30 seconds) sourced from Third-Party Services. These clips are provided solely for the purpose of the guessing game, streamed through our proxy server, and subject to availability.

9.4 No Prizes or Monetary Value

Looops is provided purely for entertainment. Game scores, streaks, and statistics have no monetary value and cannot be exchanged for goods, services, or compensation of any kind.

9.5 Social Sharing

The share feature allows you to share your game results in a spoiler-free format. You are responsible for the content and context in which you share your results.

10. Third-Party Services and Links

The Service integrates with and links to Third-Party Services including Spotify, Apple Music, and Deezer. These integrations are provided for your convenience. We do not control, endorse, or assume responsibility for the content, privacy policies, or practices of any Third-Party Services.

Your interactions with Third-Party Services are governed by their respective terms and policies. We encourage you to review the terms and privacy policies of any Third-Party Services you access through Annie.

11. Disclaimers

11.1 "As Is" Basis

The Service is provided on an "as is" and "as available" basis, without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.

11.2 No Guarantee of Availability

We do not warrant that:

• The Service will be uninterrupted, secure, or error-free.
• The results obtained from the Service will be accurate or reliable.
• Any particular track, playlist, or audio preview will be available at any time.
• Defects in the Service will be corrected.

11.3 Third-Party Content

We make no representations or warranties regarding the accuracy, completeness, or reliability of any content sourced from Third-Party Services.

12. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Annie, LogicalLey, its officers, directors, employees, agents, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, any loss of profits, data, use, goodwill, or other intangible losses, or any damages resulting from your access to, use of, or inability to access or use the Service.

In no event shall our total liability to you for all claims arising from or relating to the Service exceed the amount you paid us, if any, in the twelve (12) months preceding the event giving rise to the liability.

13. Indemnification

You agree to indemnify, defend, and hold harmless Annie, LogicalLey, and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including reasonable attorneys' fees) arising from your use of or access to the Service, your violation of these Terms, your violation of any third-party right, or any claim that your use of the Service caused damage to a third party.

14. Governing Law and Dispute Resolution

14.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Nigeria, without regard to its conflict of law provisions.

14.2 Dispute Resolution

Any dispute arising out of or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If the dispute cannot be resolved within thirty (30) days, either party may pursue resolution through the courts of competent jurisdiction in Nigeria.

14.3 Waiver of Class Action

To the extent permitted by law, you agree that any claims arising from or relating to these Terms or the Service will be brought in your individual capacity, and not as a plaintiff or class member in any purported class, consolidated, or representative proceeding.

15. Termination

15.1 By You

You may stop using the Service at any time. If you wish to delete your account, contact us and we will process your request in accordance with our Privacy Policy.

15.2 By Us

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including but not limited to a breach of these Terms.

15.3 Effect of Termination

Upon termination:

• Your right to use the Service will immediately cease.
• We may delete your account data in accordance with our Privacy Policy and applicable data retention requirements.
• Sections of these Terms that by their nature should survive termination shall survive, including but not limited to intellectual property provisions, disclaimers, limitations of liability, and indemnification.

16. General Provisions

16.1 Entire Agreement

These Terms, together with the Privacy Policy and any other legal notices or policies published by us on the Service, constitute the entire agreement between you and Annie regarding the Service.

16.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, that provision shall be enforced to the maximum extent permissible, and the remaining provisions shall remain in full force and effect.

16.3 Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

16.4 Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without restriction.

16.5 Force Majeure

We shall not be liable for any failure or delay in performing our obligations under these Terms where such failure or delay results from circumstances beyond our reasonable control.

We may provide notices to you via email, in-app notifications, or by posting on the Service. You may contact us using the information provided in the Contact section below.

17. Changes to the Service

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.
